GENERAL TERMS AND CONDITIONS

PLEASE READ THE FOLLOWING CAREFULLY:

BY PARTICIPATING AND/OR BIDDING IN THE AUCTION YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS, RULES, AND CONDITIONS:

The following general terms and conditions govern any and all transactions in connection with the 2021 Paul Revere Auction and Gala (the “Auction”).

On-Line

The on-line portion of the Auction will open for bidding on Tuesday, August 18, at 12:00 p.m., and close on Thursday, February 18, 2021, at 9:00 a.m., Pacific Standard Time. You will need to register your information and credit card before you will be able to bid on-line. The highest on-line bid for each item will carry over to the silent auction bidding at the Spring Auction party on February 20, 2021 at the Pacific Palisades Women’s Club. Bidding will reopen and continue again at 6:00 p.m. on February 20, 2021. The last on-line bidding price on each item as of Thursday, February 18, 2021 at 9:00 a.m. will be the starting price of the bids at the silent auction at the Pacific Palisades Women’s Club on February 20, 2021.

PLEASE NOTE: Being the “current highest bidder” when the on-line portion ends on Thursday, February 18, 2021 at 9:00 a.m. does NOT guarantee that you will win that item. You may still be outbid at the silent auction on February 20, 2021 at the Pacific Palisades Women’s Club and you will not receive an email notification that you have been outbid, or any notice whatsoever advising whether or not you are the highest bidder and/or whether or not bids have been submitted on any item at the silent auction on February 20, 2021.

Certain items may be available for purchase on-line at the “BUY IT NOW” price listed. When the BUY IT NOW price is listed below any Auction item, that item may be purchased immediately without waiting for the Auction category to close and/or the bidding to end.  Anyone who purchases an item for the BUY IT NOW price will instantly be deemed the highest bidder and will win that item. Said item will not carry over to the silent auction event on February 20, 2021 at the Pacific Palisades Women’s Club.   Please note that unless you BUY IT NOW, bidding on items will continue through the February 20th event.

Winning bidders will be contacted after the conclusion of the February 20, 2021 bidding process. You can register and view the on-line catalog at https://paulrevere.onlineauctionbook.com/. Not all items will be available during the on-line auction.

Check-in and issuance of bid labels/bid numbers

Upon check-in, all pre-registered bidders will receive their sheet of Bid Labels (including their individual Bid Number). Bidders who are not pre-registered on the date of the event will be issued a sheet of Bid Labels (including Bid Number) in exchange for credit card account information. To bid, please use the labels provided and affix them to the Bid Sheets of the items you desire to bid on.

Winning Bids

The participants with the highest bids at the close of the Auction (Saturday, February 20, 2021) become buyers and are obligated to purchase the items. If no bids are submitted at or above the reserve price for any given item, the Auction closes without a buyer for said item.

The success of the Auction depends on the goodwill of the donors and on careful observance by the buyers of terms stated in descriptions and restrictions. BUYERS SHOULD NOT ATTEMPT TO ALTER THE TERMS OF A BID, PURCHASE, AND/OR DONATION. Any such attempts will not be valid nor binding, and may cause the bid to be disregarded and/or voided, at the sole discretion of PRIDE and/or the Auction Committee.

Registration

The live and silent auction will take place on Saturday, February 20, 2021 (no ticket refunds will be given after February 18, 2021), starting at 6:00 p.m at the Pacific Palisades Women’s Club located at 901 Haverford Ave, Pacific Palisades, CA 90272. Upon arrival, you must register and receive bid stickers with your bid number printed. You will need bid stickers to participate in the silent auction. Use only the bid number assigned to you for bidding on silent and live auction items. Please note that the check-in process will be faster for those bidders who have registered/pre-authorized their credit card on the Paul Revere Auction website, www.paulrevere.onlineauctionbok.com.

Silent Auction

The Silent Auction opens at 6:00 PM. A bid sheet is displayed for each item. Bid sheets must stay with their corresponding item in their designated location until the Auction closes. You may bid on the item(s) by placing your bid sticker next to the desired pre-printed bid amount. Doing so constitutes a legal contract to purchase that silent auction item at that pre-printed price if your bid is the winning bid. Bid stickers may not be removed from or covered by other bid stickers on the bid sheet. All items are described on the Bid Sheets. Descriptions and instructions on Bid Sheets supersede the online Auction Catalog and should be read prior to bidding. The Auction Committee and the donor(s) are not responsible for dissatisfaction resulting from a buyer’s failure to read restrictions that may accompany auction items. ALL SALES ARE FINAL AND ALL GOODS ARE SOLD “AS IS”. The Auction Committee neither represents nor warrants, and shall in no event be responsible for the correctness of the description or genuineness, authorship, provenance or condition of the items or quality of services rendered. No statement contained in the catalog or made orally at the auction or elsewhere shall be deemed to be such a warranty, representation or assumption of liability.

Minimum bids are at a substantial discount of the actual value of the item. If a bid is below the minimum bid amount, it will not be valid. Bids will be accepted on each item in a category until the closing time for that category. Bidding on an item must stop when the Silent Auction officials (volunteers assigned to work the Silent Auction) close the bidding. No bids will be accepted or considered after the closing time for the bidding. The last (highest) valid bid placed prior to the section closing will be the winning bid.

Some items will indicate that they have a BUY IT NOW bid amount. Placing your sticker next to that BUY IT NOW bid amount will close the bidding for this item, and you will be the winner of this item. By placing your bid sticker in this box, you are legally bound to purchase the item at the BUY IT NOW price indicated.

There are certain Silent Auction items of which we have secured multiples of the same exact item. The bid sheets will state the number of exact items available. For these items, the number of winners will be indicated on the bid sheet.

All sales are final. The Auction Committee reserves the right to withdraw and/or modify any item at any time without notice before the actual sale. The Auction Committee also reserves the right to combine items at any time or lower the minimum bid without notice before the actual sale. In the event of a dispute, the Auction Committee shall act as final authority in determining the winning bid. The entire silent auction will close at approximately 8:00 PM.

Live Auction

Live Auction bidding will begin at approximately 8:00 PM. When bidding, please hold up your bid number facing the auctioneer. Every effort will be made to identify and recognize all bids, but it is your responsibility as a bidder to make your bid known. The Live Auction will continue until all items are sold. If a group is bidding on one item, please designate one person to place your combined bid. Auction items will be awarded to one purchaser only. Said individual will be individually and personally bound to purchase and pay for the item. A bid acknowledged by the auctioneer is a legal contract to purchase the item. All sales are final.

Payment

At the end of the night, bidders should proceed to the cashier ("check-out") area for item(s) won or to learn if item(s) have in fact been won.

All items must be paid for by no later than February 20, 2021, at 10:00 p.m. For your convenience, we gladly accept cash, personal checks, MasterCard, Visa and American Express. Credit Card information should be provided at check-in registration to speed up the payment process at the end of the evening.

Pick-Up

At redemption, you will be issued a receipt with which you’ll be able to claim your winning merchandise and/or certificates. Volunteers will be working as quickly as possible to collect your items for you. Please be patient. It is the responsibility of the purchaser to remove his/her winning item(s) by the end of the Auction, by no later than February 20, 2021, at approximately 10:00 p.m. No refunds will be given for lost or misplaced items.

Delivery

If you would like, you may pick up your winning items at school within one week from the date of the Auction. There will be a $25 fee added to your bill. All winning items left behind at the event will be taken to school and automatically assessed the $25 delivery fee.

Terms of Participation and Sale

By electing to participate in the Auction, and/or by purchasing any item(s) through or in connection with the Auction, and/or by bidding on any item(s), the buyer waives any claim for liability against Paul Revere Charter Middle School, Paul Revere Booster Club, PRIDE, and each of their respective elected and appointed officials, members, chairs, employees, sponsors, representatives, agents, officers, directors, principals, affiliates, volunteers, anyone affiliated with or connected with the Auction, and/or any and all donors of any and all items offered at the Auction.

FULL RELEASE OF RESPONSIBILITY: Paul Revere Charter Middle School (PRMS), Paul Revere Booster Club (PRIDE), and the Auction Committee and any entities thereof cannot provide any servicing or guarantee on any item. Paul Revere Charter Middle School (PRMS), as recipient of the item from its donor specifically disclaims any knowledge of or familiarity with the item except as set forth in the donor’s description. Purchaser bears responsibility and fully releases Paul Revere Charter Middle School (PRMS), and its administrators, faculty and staff, as well as Paul Revere Booster Club (PRIDE) and its officers and volunteers and the Auction Committee from any and all responsibility including, but not limited to, negligence, and for all damages, injury and/or consequences flowing or resulting from the participation in or use or application of any donated item. It is the responsibility of the recipient to investigate any and all potential risks of any items or service purchased. Paul Revere Charter Middle School (PRMS) makes no representation or warranty regarding the use of any item, nor with respect to availability or sufficiency of any insurance coverage in connection with such use. By his/her purchase, the buyer hereby releases and holds Paul Revere Charter Middle School (PRMS), harmless for such damage and liability.

Limitation of Liability. By participating in the Auction, and/or by submitting a bid and/or by purchasing any item at the Auction, you expressly agree to limit any and all liability by any and all entities and persons acting in connection with or on behalf of the Auction to the total sum of One Hundred Dollars ($100.00), whether the liability is the result of intentional, accidental, negligent, reckless, wrongful, unlawful, and/or otherwise improper and/or inappropriate conduct by any individual and/or entity, irrespective of whether or not said damage was incurred, and notwithstanding any other and/or additional damages which you might incur and/or suffer, including damages for which no remedy at law exists. This limitation of liability clause expressly limits all liability whether by contract, tort, malfeasance, or otherwise. By participating, you expressly agree to waive any and all claims for consequential, special, and general damages.

Bidding Increments. 

The Auction Committee reserves the right to name a minimum bid and designate minimum bid increments for any and all item(s). 

Omissions.  

The Auction Committee believes all descriptions and commentary accompanying the Auction items to be accurate; however, the Auction Committee makes no warranties nor representations of any kind regarding the descriptions provided of the items, services, values, expiration dates or restrictions.. We apologize for any errors or omissions. 

All items and/or services are subject to the terms and conditions specified by the donors, and all of the terms and conditions as set forth in this Auction Rules and Terms and Conditions. All sales are final. There will be no exchanges or refunds. Neither Paul Revere Booster Club (“PRIDE”) nor any Auction Committee members or volunteers have made any expressed or implied warranties or guarantees on any Auction items, including without limitation regarding the quality, value of items or services, the use or safety of goods and services sold, including, without limitation, the implied warranties of merchantability and/or fitness for a particular purpose. Each Bidder and/or buyer voluntarily assumes upon itself, himself, and/or herself, the entire risk of the quality, performance, and/or safety of any and all items involved in and/or offered in connection with the Auction. PRIDE has not tested or inspected the goods and services for their quality and safety, and PRIDE makes no representations of any kind with respect to any of the items offered at the Auction. Some of the activities offered at the Auction may be considered “high risk.” By bidding and/or purchasing any item at the Auction, each bidder and buyer represent that they have diligently and independently investigated and researched the item prior to having bid on and/or purchased the item, and further that said bidder and/or buyer did not rely on any representations made by PRIDE, including without limitation any representation made in connection with the Auction by any individual and/or entity acting in connection with, or on behalf of, PRIDE and/or the Auction. By bidding and/or purchasing any item in connection with the Auction, each and every Bidder and/or purchaser acknowledge and represent that they have each voluntarily and freely considered and accepted onto themselves all risks associated with the item, including without limitation its use, operation, and/or purchase. PRIDE shall not be responsible for any injuries or damages that result from the buyer’s use of and/or purchase and/or bid on the Auctioned items or services or from participation in services or activities purchased.

There will be NO REFUNDS, EXCHANGES, TRANSFERS OR SUBSTITUTIONS (unless otherwise specified on the Bid Sheet). The values indicated on gift cards and certificates are for merchandise and services and cannot be redeemed for cash, and do not include tax, service charges, gratuity or service charges unless otherwise stated.

If there is any problem with any item, whatsoever, your purchase will be deemed a donation to PRIDE for the benefit of Paul Revere Charter Middle School.

We have attempted to describe and catalog all items correctly, but all items are offered and sold "AS IS" and "WITH ALL FAULTS." Neither PRIDE nor any Auction Committee members or volunteers warrant or represent, and in no event shall be held responsible for, the correctness of descriptions, genuineness, authorship, provenance or condition of the items. No statement made in this catalog and/or in connection with the Auction and/or the items and/or products and/or services described therein, whether made at the Auction or elsewhere, orally or in writing, shall be deemed such a warranty for tax purposes or market value. None of the items have been appraised. Reservations for trips and vacation accommodations must be mutually arranged with the donor unless otherwise noted. No refunds will be allowed on travel packages for canceled tickets and/or accommodations, or for any item and/or product and/or service offered and/or bid and/or purchased at the Auction.

It is your responsibility to abide by all instructions and limitations specified on certificates. Certificates are not exchangeable for cash. Winners must present certificates at the time of redemption, or, in the case of certificates for services, at the time of scheduling such services.

Reservation dates for use of vacation homes, condominiums hotels, resorts, tickets to events and/or other services must be mutually agreed upon with the donor(s) and are subject to availability. The winning bidder must treat and care for the property in an appropriate manner. The winning bidder of a privately owned condominium/vacation home is responsible for any damages as a result of the stay. All transportation and vacation packages Items are non-transferable, non-redeemable for cash and non-negotiable for upgrades or substitutions unless otherwise noted. Paul Revere Charter Middle School (PRMS) is not responsible for increases in transportation, tariffs or fares, room rates or taxes. Unless otherwise stated, all auction items and services must be used by February 20th, 2022 and are subject to the terms and conditions set forth by the donors. Please be mindful of any expiration dates with respect to any items or services. It is the BUYER’S responsibility to initiate contact with the donor for such items as homes, tickets and services to arrange for their use. Such initial contact should be made by the purchaser within sixty (60) days of the event date.

Restaurants

Reservations are required for most establishments. Unless otherwise noted, alcoholic beverages, taxes, and gratuities are generally not included and no credit may be applied towards such items.

Services

Gratuities for stylists, technicians, trainers and other service providers are generally not included in gift certificates. Please remember to show your appreciation accordingly.

Tickets/Passes

Events, performances, and museum tickets/passes that do not specify a date may require advance reservations and be subject to availability.

Final Decisions

This Auction is reserved for Paul Revere families and friends only. The Auction Committee's decision is final in all events and under all circumstances.   Thanks for your generous support.  

Tax Information

This catalog lists the estimated fair market value of each item. Any amount you pay in excess of the fair market value may qualify as a charitable contribution. However, PRIDE and/or the Auction and/or the Auction Committee do not make any representations and/or warranties in connection with any matters involving taxes and/or accounting. Please check with your tax advisor for specifics.
